supported civil rights. when you define liberal and conservative, people support medicare with all their hearts and they do like this stuff, they like that we have a mixed capitalism with some social welfare mixed in to soften it and that makes them practical people and makes them liberal in a sense of functionality but not, i'm a liberal. your thoughts? >> you know, i agree. chris, two things have happened over the course of the last 20, 30 years. you have this slow turning away from the ideas of the new deal, at least from other people. the notions that these are handouts when it applies to other people, just by default, any democratic that gets elected, it was illegitimate. and then clinton comes along, he's illegit. you had it with kennedy. dead people in chicago really elected him. then clinton came along. he did win. i would think there was this notion that bill clinton was inherently illegitimate and nothing too extreme to dislodge him from the white house because he was de-facto illegitimate. and i think with barack obama, this notion that this could not have happened. this was a

new term dominated by civil rights issues. joining me from the supreme court, nbc news justice correspondent pete williams. pete, we're talking about major cases that will reshape potentially reshape policy for the united states on affirmative action, voting rights, and on gay marriage. >> very much so. let's begin with affirmative action president the court will hear that case next week. every selective university in america uses it in some manner to achieve a racially diverse campus. this is a case from the university of texas. a young high school student there did not qualify automatically as the top 10% of graduates in texas do for admission, so she was looked at in in the remainder of the other 25% of the class, race is a factor, says that's unconstitutional. nine years ago the supreme court gave the green light to colleges to use affirmative action if there were no race neutral methods to get to diversity. the question is whether the court has changed and become more conservative when they look at it they probably won't be as generous with affirmative action. the second c

, traditionally democratic blocs. during the democratic national convention, georgia congressman and civil rights icon john lewis compared some voter i.d. statutes to literacy tests and poll taxes that kept blacks from voting for years in the south. >> i've seen this before. i lived this before. too many people struggled, suffered, and died to make this possible for every american to exercise their right to vote. ( applause ) >> suarez: nationwide pennsylvania is now one of 33 states with voter identification laws. it's one of five states with strict photo i.d. laws. the statutes have spawnd at least 15 legal challenges over everything from voter i.d. to early voting to culling voter rolls. in florida, the state republican party has filed a fraud complaint against the company it hired to register voters. as of friday at least 10 counties have spotted possibly fraudulent forms turned in by the firm. back in pennsylvania another eye peel to the state supreme court remains possible. in the meantime, the new rules have already been modified, prompting new coalitions to form with the aim of hel

that down which would be an enormous change in a landmark civil rights law. >> take us inside the supreme court and how this works and how they decide what cases get done when and when we might hear some of these decisions. >> well, it's the same procedure. and it's unusual. because if you are in a state, the state supreme court must hear your case. not true here. the supreme court decides for the most part which cases to hear. it takes four votes mong the justices to grand a case. of course, takes five votes to win out of the nine. they confer on which cases they want to talk about. then they vote and then we hear about it on days like today when we get the orders list. but the reason i say with some confidence that they'll take the voting rights act case is because of the way the federal law works. if you get turned down by the federal government, the congress virtually requires the supreme court to hear those. i think it's likely they'll take up the voting rights challenge and the defense of marriage. >> pete williams, always good to see you. thanks. >> my pleasure. >>> the fir

found that it actually may be violating some students' civil rights. specifically right now african-american students make up about 32% of all students in oakland public schools, but they receive 63% of all the suspensions given out. in may the department of education's office of civil rights looked into whether the district treated black students more harshly than white students. the agreement means that there will be changes happening within the next five years. the district will move towards restorative type discipline instead of zero tolerance. now, instead of the initial 11 schools that they talked about, they'll roll this out in 38 of its 86 schools. what they want to do is bring down the suspension rate overall, including suspensions for african-american and special education students. they'll try and reduce defiance-related suspensions. civil advocates say that it's rather vague. now that the board has gone ahead and approved this, what this means is that the entire federal investigation is over and complete. reporting live in oakland, christie smith, "today in the bay." >>>

civil rights cases. and i think it's entirely poible the court may limit or even overrule justice o'connor's opinion getting rid of racial preferences more and more. >> so this is a case involving a state university, aic university. so if they decide that affirmative action giving a preference to certain students based on race for example is unconstitutional, would it also automatically apply to private universities that get federal aid, for example? >> not automatically. but this is the way the court works is that they decide one case at a time. and they establish principles that are later applied or not applied. each case can be somewhat diffent. but if t say that a university which is a part of the state may not consider race, that race is simply impermissib impermissible, you can be sure that that message will filter out not just through universities but also to employers and to the government. it could be an enormous change. we'll only deal with public universities this term. >> let me read to you from your column you wrote on cnn.com. very provocative but important as well.

laws may deter 10 million hispanics. it is a civil rights group the advancement project that came out talking about the potential impact of all of the various efforts in particularly states where there is a big latino population. is that related to this voter i.d. or you know, what other forms, attempts of voter suppression. >> it is related to voter i.d. but we're seeing a lot of other techniques. so in florida, they made it very, very hard to do voter registration drives, the paperwork requirements were very ominous and it was a crime if you didn't comply with them. most organizations including the league of women voters decide they didn't want to play. that law was struck down by a federal court but it did a lot of damage while it was in effect. you're seeing attempts to take away people's ability to vote early so we've got -- took early voting starting in iowa in places like ohio and florida. you're seeing laws passed to reduce the number of states where early voting can happen. that does have an impact, like i said, minority voters are more likely to not have i.d. as it turns out

civil rights following the blockbuster decisions we all watched last term, involving immigration and president obama's health care law. shannon bream now with the news from washington. shannon? >> monday kicks off the brand new term in the supreme court and there are a number of controversial disputes awaiting the justices. at least six of nine justices attended the traditional pre-term red mass in washington on sunday, a tradition started back in 1928 in new york, praers for wisdom and inspiration for all members of the judiciary. on monday the court will consider whether nigeria citizens can sue shell oil company in u.s. court for human rights abuses they say the company committed in nigeria, one of the most anticipated, student who she was not admitted to the university because of race based. and justice kennedy will be the swing vote in that case and expected to take up one case related to same sex marriage and defense of marriage act which the obama administration says it will no longer defend in court. another appeal involved counseling prop 8 amend the constitution so cali
